Overview
These Terms of Service (“Terms”) govern your access to and use of the website located at gnomearms.com (the “Site”) and any products, services, or transactions provided by GnomeArms LLC (“GnomeArms,” “we,” “us,” or “our”). By visiting the Site, creating an account, placing an order, or otherwise interacting with GnomeArms, you agree to be bound by these Terms, our Privacy Policy, our Shipping Policy, and our Return & Refund Policy. If you do not agree, do not use the Site.

1. Eligibility and Age Requirements
You must be at least 18 years old to browse the Site, create an account, or place an order. By using the Site, you represent and warrant that you meet this minimum age requirement and that you are not prohibited from receiving firearms, ammunition, or related items under federal, state, or local law.
Federal law imposes additional age-based restrictions on specific categories of merchandise, which apply at the time of transfer regardless of the age at which an order is placed:
• Handguns and handgun ammunition: Must be transferred only to persons 21 years of age or older under 18 U.S.C. § 922(b)(1).
• Long guns (rifles and shotguns) and long-gun ammunition: Must be transferred only to persons 18 years of age or older.
• NFA items: Must be transferred only to persons 21 years of age or older and are subject to the National Firearms Act approval process.
If you place an order for an item you are not legally eligible to receive, we will cancel the order. Age and eligibility are verified by the receiving FFL dealer at the time of transfer via ATF Form 4473 and NICS, not at the time of purchase. You are responsible for ensuring you are legally eligible to take possession before placing an order.

2. Firearms Transactions and Federal Law
GnomeArms LLC is a federally licensed firearms dealer (FFL No. 5-83-037-07-9D-04736) operating in compliance with the Gun Control Act of 1968, the National Firearms Act, ATF regulations (27 C.F.R. Parts 478 and 479), and applicable Wyoming law. All firearm transactions are subject to these laws, including but not limited to:
• Completion of ATF Form 4473 by the transferee
• Successful NICS background check or equivalent state-authorized check
• Compliance with all state and local laws in the transferee’s jurisdiction
• Transfer of firearms to a licensed FFL dealer in the transferee’s state, except as otherwise permitted by law
No sale is final until all applicable federal, state, and local legal requirements have been satisfied. GnomeArms LLC reserves the right to refuse, cancel, or rescind any transaction that cannot be lawfully completed.

3. User Accounts
You may create an account on the Site to facilitate orders, track shipments, and manage transfer paperwork. By creating an account, you agree to:
• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use or suspected security breach
You may not transfer, share, or sell your account. GnomeArms LLC reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or is used in a manner inconsistent with applicable law.

4. Orders, Pricing, and Payment
All orders placed through the Site are offers to purchase, which GnomeArms LLC may accept or decline in its sole discretion. An order is not accepted until you receive written confirmation from us. We reserve the right to:
• Limit quantities, refuse service, or cancel any order at any time prior to shipment
• Correct pricing errors, typographical errors, or product description errors, including after an order has been placed
• Verify identity, age, and eligibility prior to shipment or transfer
Prices are listed in U.S. dollars and are subject to change without notice. Applicable taxes, transfer fees, FFL fees, shipping charges, and Hazmat surcharges (where applicable) will be displayed at checkout or invoiced separately. Payment must clear in full before an order is processed or shipped.

5. Shipping and Delivery
Shipping is governed by our Shipping Policy, which is incorporated into these Terms by reference. Firearms ship only to a licensed FFL dealer in the buyer’s state. Ammunition, accessories, and non-firearm items ship in accordance with the Shipping Policy and applicable law. The buyer is responsible for FFL selection, transfer fees charged by the receiving FFL, and compliance with state and local law at the destination.

6. Returns and Refunds
Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. Certain categories of merchandise — including ammunition, NFA items, and completed firearm transfers — are non-returnable as described in that policy and as required by federal law.

7. Prohibited Uses
You agree not to use the Site or any GnomeArms LLC service to:
• Violate any federal, state, or local law or regulation
• Purchase, attempt to purchase, or facilitate a straw purchase of any firearm or ammunition
• Misrepresent your identity, age, citizenship, or legal eligibility to possess firearms
• Circumvent or attempt to circumvent ATF Form 4473, NICS, or any other legally required screening process
• Use the Site to harass, threaten, defame, or harm any person
• Upload or transmit malicious code, viruses, or any content that interferes with the Site’s operation
• Scrape, data-mine, or otherwise extract data from the Site by automated means without our prior written consent
• Resell, redistribute, or commercially exploit any content or product obtained from the Site in violation of these Terms or applicable law
Violation of this section may result in cancellation of orders, termination of your account, and referral to law enforcement.

8. Intellectual Property
All content on the Site — including logos, product photos, text, graphics, trademarks, and the “GnomeArms” brand — is the property of GnomeArms LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent, except as permitted by fair use or applicable law. Product images supplied by manufacturers or distributors remain the property of their respective owners.

9. Third-Party Links and Content
The Site may contain links to third-party websites, manufacturer pages, or external resources. GnomeArms LLC does not endorse, control, or accept responsibility for the content, accuracy, or practices of any third-party site. Your use of any third-party site is at your own risk and subject to that site’s terms.

10. Disclaimer of Warranties
The Site and all products and services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, except as required by applicable law. To the fullest extent permitted by law, GnomeArms LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. Firearms and related products are sold subject only to the manufacturer’s warranty, if any. GnomeArms LLC is not the warranty provider for new firearms and makes no independent warranty on used or pre-owned merchandise, which is sold AS-IS.

11. Assumption of Risk
You acknowledge that firearms, ammunition, and related products are inherently dangerous and that their use, handling, and storage carry significant risks, including the risk of serious injury or death. You assume all responsibility for the safe and lawful use, handling, storage, transport, and disposal of any product purchased from GnomeArms LLC. You are solely responsible for familiarizing yourself with and complying with all applicable federal, state, and local laws regarding firearms ownership, possession, transport, and use.

12. Limitation of Liability
To the fullest extent permitted by law, GnomeArms LLC and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, personal injury, or property damage — arising out of or in connection with your use of the Site, any product purchased from us, or any act or omission related to these Terms, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or any product sold shall not exceed the amount you paid to GnomeArms LLC for the specific product giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

13. Indemnification
You agree to indemnify, defend, and hold harmless GnomeArms LLC and its owners, officers, employees, and agents from and against any claim, demand, loss, damage, cost, or expense (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site or any product purchased from GnomeArms LLC; (b) your violation of these Terms or any applicable law; (c) your misrepresentation of identity, age, or legal eligibility; or (d) your negligent, unlawful, or intentional misuse of any firearm, ammunition, or related product.

14. Binding Arbitration and Class-Action Waiver
Please read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product or service provided by GnomeArms LLC shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in Sweetwater County, Wyoming, or by remote hearing where permitted, before a single arbitrator. Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.
Class-Action Waiver: You and GnomeArms LLC each agree that any claim will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate claims of multiple parties or preside over any form of class proceeding.
Jury-Trial Waiver: You and GnomeArms LLC each waive any right to a jury trial for any dispute subject to these Terms.
Exceptions: Either party may bring a claim in small-claims court in Sweetwater County, Wyoming, if the dispute qualifies, and either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights or enforce the obligations of Section 7 (Prohibited Uses). Nothing in this section prevents the parties from reporting any matter to, or cooperating with, a government agency.
Opt-Out: You may opt out of this arbitration provision by sending written notice to GnomeArms LLC, Green River, Wyoming, within 30 days of first accepting these Terms. Your notice must include your full name, mailing address, and a clear statement that you wish to opt out of arbitration.

15. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-laws principles, and applicable federal law. Subject to the arbitration provision in Section 14, any action not subject to arbitration shall be brought exclusively in the state or federal courts located in Sweetwater County, Wyoming, and you consent to the personal jurisdiction and venue of those courts.

16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and GnomeArms LLC with respect to your use of the Site and supersede all prior or contemporaneous understandings, agreements, or representations on the same subject matter.

18. Changes to These Terms
GnomeArms LLC may modify these Terms at any time. Updates will be reflected by the “Last Updated” date at the top of this document and posted at gnomearms.com. Your continued use of the Site after any change constitutes acceptance of the revised Terms. The Terms in effect at the time of your purchase govern that transaction.
